Pre and Post Nuptial

A Pre-Nuptial Agreement (often also known as a Pre-Marital Agreement) is an agreement between yourself and your partner prior to getting married.

A Post-Nuptial Agreement (often also known as a Post-marital Agreement) is an agreement between yourself and your partner during your legal marriage.

Reasons for considering Pre-Nuptial and Post-Nuptial agreements

Pre and post-nuptial agreements are useful in the following circumstances:-

  • Where either party is expecting future wealth and/or inheritance;
  • Protecting savings or inheritance for children;
  • Disparity in wealth between the parties to the marriage;
  • Protection of a business.

Are Pre-nuptial and Post-Nuptial agreements legally binding?

Currently, Pre and Post-Nuptial Agreements are not legally binding in court and cannot override the Court’s power to decide how finances are divided on divorce. However, the Court is now likely to give substantial weight to an agreement if the it has been drafted and entered into correctly.
