Financial Settlement

The breakdown of a marriage, civil partnership or a relationship can be a difficult time for all parties.  The procedure for divorce, dissolution or separation is usually straightforward. However, difficulties often arise in relation to the division of property and finances following separation.

Here at Chris Stevenson Solicitors we will deal with your case in a sensitive, supportive and professional manner throughout the whole process.

Financial Settlement by Consent

Reaching a financial settlement/agreement with your ex-partner – by mutual consent – is often quicker and less stressful for both parties involved. It is crucial, however, to ensure that this agreement becomes legally binding. These agreements are known as ‘Consent Orders’.

The drafting of a consent order, is key to making your agreement legally binding. This Consent Order outlines the specifics of your financial settlement and provides clarity to both parties. Once approved by the Court, the Consent Order becomes legally binding and can be enforced by the court should its contents not be adhered to fully.

Chris Stevenson Solicitors can support you in negotiating, drafting and formalising a Consent Order that is legally binding with the Court.

Financial Settlements where the parties cannot agree

If you and your ex-partner cannot agree the division of property and finances, you may need to consider making an application to the Court to resolve matters.

The Court has a wide range of powers to make orders relating to property and finances. Our Team will provide you with specialist advice throughout the process.

What financial settlements are available

Either by consent or as a result of financial proceedings before the Court, the following orders are available:-

  • Lump Sum payment;
  • Sale/Transfer of Property;
  • Pension Share/Attachment;
  • Spousal Maintenance.

The starting point for dividing financial assets on divorce is usually an equal split. However, there are a number of factors that the Court will consider when determining the final outcome of court proceedings.
